Google Looses Fair Use Suit In Belgium Court Over Use Of Content From Belgian Newspaper

A Belgian press association reported that the Belgian Court of First Instance has threatened Google with daily fines of $1.27 million in a ruling in September 2006. The suit orders Google to stop publishing content from Belgian Newspapers without the payment of fees, or explicit permission.

Margaret Boribon, seretary general of the association, said that the individual newspapers may set separate fees for separate articles, so it is not known how much Google would actually have to pay for the right to use the content.

Google is also defending against a Agence France-Presse lawsuit filed in the United States District Court in Washington D.C., for at least $17.5 million in damages. The suit claims that the Google page looks too much like that of the AFP. Google is arguing in this case that it's use is covered by the "fair use" provisions of copyright law.

Google spokeswoman Rachel Whetstone said that Google is helping drive traffic to the news sites, and that any news organization could have requested not to participate, without going to court. Legal scholars say that the Google service could add value by significantly improving "the news-consming experience".
